Terms of Service

1. Parties to the Agreement

This document constitutes a legally binding agreement between you ("Client" or "User") and Next11 AI Agency SAS, developer and owner of the HostRest360 platform, accessible at https://hostrest360.com ("the Service").

By signing a proposal, statement of work or other service agreement, or by using a contracted deliverable, you confirm that you have read, understood and accepted these Terms. If you do not agree, do not contract or use the Service.

2. Description of the Service

HostRest360 provides modular technology and implementation services for lodging establishments. Depending on the signed proposal, the contracted scope may include:

  • Website and direct-booking request tools.
  • Supported messaging, PMS and OTA integrations.
  • AI-assisted guest communication based on approved content.
  • Operational, staff and reporting workflows.
  • Custom implementation and related support.

Modules, integrations, setup work, monthly services and custom deliverables are limited to the scope confirmed in writing.

3. Contracting and Access

Services are contracted through a proposal, statement of work or equivalent written agreement. The Client must provide accurate project, billing and integration information.

If access credentials are issued as part of an implementation, the Client is responsible for protecting them and for authorized activity performed through that access.

4. Plans, Pricing and Billing

Public package prices are detailed in the Pricing section of https://hostrest360.com. Final scope, setup fees, monthly services, payment schedule and applicable taxes are confirmed in the Client's written proposal.

Charges are invoiced and collected according to the signed proposal. HostRest360 does not rely on self-service signup or automatic billing unless the Client expressly agrees to those terms in writing.

Changes to an active scope or price require written notice and apply according to the governing proposal or renewal agreement.

5. Cancellation and Refund Policy

Cancellation, project termination and any remaining payment obligations follow the signed proposal and the Refund Policy. Requests must be submitted by email; there is no self-service cancellation dashboard on this website.

Refund requests are reviewed against the contracted scope, work already delivered and applicable written terms. For requests, contact hola@next11.co.

6. Acceptable Use

The Client agrees not to use the Service for:

  • Illegal or fraudulent activities, or activities that violate third-party rights.
  • Sending unsolicited bulk messages (spam) through the integrated channels.
  • Attempting to access, interfere with or damage the systems of Next11 AI Agency SAS or third parties.
  • Reselling, sublicensing or redistributing the Service without express authorization.
  • Reverse engineering, decompiling or disassembling any component of the Service.

7. Intellectual Property

All intellectual property rights in the Service, including the software, design, brand, logos, AI algorithms and documentation, are the exclusive property of Next11 AI Agency SAS or its licensors. The Client obtains only a limited, non-exclusive, non-transferable license to use contracted deliverables for the applicable service term and agreed purpose.

The Client's business data and information remain the property of the Client. Next11 AI Agency SAS claims no ownership rights over the data the Client enters into the Service.

8. Confidentiality and Data Protection

Both parties agree to maintain the confidentiality of the information exchanged. The processing of guests' personal data and property information is governed by our Privacy Policy, which forms an integral part of these Terms.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Next11 AI Agency SAS shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of revenue, data or profits, arising from the use of or inability to use the Service.

The total liability of Next11 AI Agency SAS to the Client for any claim shall not exceed the amounts paid by the Client in the 3 months prior to the date of the event giving rise to the claim.

10. Availability and Support

Next11 AI Agency SAS strives to keep the Service available as much as possible. However, it does not guarantee 100% availability. Interruptions may occur due to scheduled maintenance, force majeure or causes beyond our control.

Technical support is available via email at hola@next11.co. Response times vary according to the contracted support scope.

11. Changes to these Terms

Next11 AI Agency SAS reserves the right to modify these Terms at any time. Material changes will be notified to the Client at least 15 days in advance by email or through a prominent notice in the Service. Continued use of the Service after such notification constitutes acceptance of the modified Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Colombia. Any dispute that cannot be resolved amicably shall be submitted to the jurisdiction of the competent courts of the city of Medellín, Colombia, unless applicable law requires another jurisdiction.
